COVID-19 Update Release

I understand the COVID-19 virus has a long incubation period during which carriers of the virus may not show any signs or symptoms and still be highly contagious. I understand Heather Beach Photography, will take all precautions suggested with COVID-19 prevention but it is impossible to determine who has it and who does not given the current limitations in virus testing.

I understand that should I be diagnosed to be COVID-19 positive within 14 days following my session, I will contact Heather Beach Photography to let them know of my positive.

I release Heather Beach Photography from any and all liability associated with receiving a COVID-19 positive diagnosis following our session.

I confirm that I am, nor anyone attending the session is not presenting any of the following symptoms of COVID-19: Fever, Shortness of breath, Dry cough, Runny nose, or Sore throat

Should I or anyone that attended the session present with any of these symptoms (Fever, Shortness of breath, Dry cough, Runny nose or Sore throat) within 14 days of my scheduled session, I will contact Heather Beach Photography to reschedule my session.

I understand that Heather Beach Photography reserves the right to cancel or reschedule any session at any point in time due to COVID-19 implemented regulations, health concerns, possible exposure, or arising symptoms of COVID-19, and is not liable for any costs accrued by the client (i.e. hair appointments, cakes, balloons, etc) in association with my session.

I understand that I need to keep at least 10 feet distance from the families before/after my session and instruct my children to do so also.

*Heather will be using a long lens to keep distance from families for the majority of the session, however if she needs to come closer to instruct, get kids attention or use another lens and has to be closer than 10 feet, she will put on a mask.

As of the date above, the Client (named above) referred to as "Client," enters into the following agreement with Heather Beach Photography, hereafter referred to as "Photographer." This contract constitutes the entire agreement between both parties and will apply to all future transactions.

A. Session Fee
Client agrees to pay photographer the session fee at the time of booking to ensure the date. This session fee is nonrefundable, however transferable to another session within the year if only a sickness occurs. This session fee covers the time and talent of photographer, basic retouching and creative editing of images, as determined by the photographer, and 10 digital images (depending on session) with print release from gallery of 10+ images.

B. Location Costs & Fees
Heather Beach Photography will be choosing each location for Mini Sessions.

C. Rescheduling and Re-shoots
If an illness or situation prevents a photo session from taking place, client forfeits session but photographer will try to reschedule if possible. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control. Client(s) will be allowed to reschedule once.


D. Pre-Consultation

A pre-consultation will be done via online questionnaire. Pre-consultation will cover visions/exepectations for shoot, personality of baby/children, color schemes, clothing choices, your style and possible products you'd like from the session.

E. Proofs
Proofing of client’s images will be available through an online gallery. Clients will be shown 10+ images that are "soft proofed" meaning, most editing is completed however more precise editing such as fixing skin imperfections, colors casts and distracting background objects will be done once final images are chosen. 10 digital images are included however clients may choose to purchase additional images and/or prints and products.

F. Ordering
All ordering of prints and digital images will be done through an online gallery. If you would like to schedule an appoinment with Heather to discuss possible options for decorating your home with images, you may also do that. All purchased images will be archived by photographer indefinitely. All images not chosen will be purged.

 

G. Damage
Photographer is not responsible for the damage of portraits after delivery to client, including damage caused during transit by US mail. Client assumes all responsibility for the safety of all portraits upon receipt.

H. Model Release
The Client hereby grants Heather Beach Photography permission to license the images taken by Heather Beach and to use the images in any media for any purpose (except pornographic or defamatory) which may include, among others, advertising (including online), promotion, marketing and packaging for any product or service. The client agrees that the images may be combined with other images, text and graphics, and cropped, altered or modified. The client agrees that they have no rights to the Images, and all rights to the Images belong to Heather Beach Photography.

I. Good Imagery
The Client(s) grants Heather Beach Photography artistic license in photographing and editing the session. All decisions are made in the best interest of the client, who will be given the highest quality selection from the images taken. Decisions regarding location, poses, and number of photographs created and presented shall be deemed to be correct and the image collection complete. Client(s) will only be presented and given the EDITED images.

J. Liability
Photographer is not responsible for any injuries or illnesses inflicted upon any participating parties. This includes both on location and in the Photographer’s studio. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.

K. Copyright & Penalty
Client may use Photographer’s image on Facebook as long as the watermark is left on the photo and is viewable. Heather Beach Photography retains all copyrights to all images created during client’s session. A print release will be given with the purchase of digital files to print portraits for personal use up to designated size listed on print release. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering of your images without the photographer’s written permission. It is illegal to copy, scan, download, print, share, alter, or otherwise steal any image created by Heather Beach Photography during client’s photo session. This applies to "sneak peek" images, images posted in an online proofing gallery, blog, Facebook, or hard copy images.

The Client(s) agrees to the listed A-K agreements above.
